1 Introduction
Italian Video Courses is a web portal, managed by Stefano Manfrin, aimed at teaching Italian; for this purpose, it is offered to registered users unlimited access to educational materials and contents classified as "free material".
The Portal can be used in three languages: italiano, inglese e portuguese.
The platform offers all users free articles with translation to explore aspects of Italian culture, access an area where Italian expressions are explained and placed in the context, a verb conjugator and, as a preview of the paid video courses, some exercises and video lessons. In addition, free registered users have guaranteed access to the community: an area where members can find people to practice Italian through the exchange of non-instantaneous messages (the system emulates delivery times from traditional postal service), and where they can talk to each other by organizing chats and video chats, being able to take advantage of exercises and games that simulates daily situations to be carried out in pairs.
Users, who purchase one of the premium subscriptions, have access to additional exclusive educational material. The purchasing of a subscription will grant permission to the user to use the educational material for a fixed-term period that changes according to the conditions of the purchased subscription. The exclusive material will be made accessible to the user from a specific website area where "students" will be able to book also private online lessons with Italian teachers partnered with Italian Video Courses, to get help in understanding the material and be guided in the learning process.
The portal is accessible at the URL https://www.italianvideocourses.com using an Internet browser.
To get more information, registered users can book a free informational video chat with one of the partnered teachers (accordingly to teachers' availability).
In accordance to the conditions accepted by the user during the purchase, the premium subscriptions allow the access for a fixed-term period to a series of video lessons and thematic lessons on grammar, expressions and the Italian lexicon accompanied by interactive verification exercises. The subscriptions may also permit the "students" to ask for writing exercises corrections and to attend private online lessons.
Italian Video Courses is addressed to both natural and legal persons. Please, consult our Privacy Policy to acquire more information about the use and protection of data. (link: https://www.italianvideocourses.com/it/privacy-policy.php).
The service called "Italian Video Courses" is managed by Stefano Manfrin, an individual enterprise having the registered office in Via Correr, 19/6 – 33080 Porcia (PN) – ITALIA, C.F. MNFSFN88S16G888N, P.IVA 01794780930 (VAT registration number), who uses his own structure and organization, which also includes a network of partnered teachers. The individual enterprise Stefano Manfrin is hereinafter also called "Italian Video Courses", expression which therefore indicates, depending on the context in which it is used, both the Italian web portal and the legal person providing the service.
2 Context, definitions
In these Terms and conditions of use Italian Video Courses (hereinafter the "General Conditions" also abbreviated with GC) "Italian Video Courses" will be abbreviated with IVC; the registered user who benefits from the free services of the site is identified with the term CLIENT; the user who benefits from the free and the paid services is identified by the term STUDENT; the CLIENT and the STUDENT can also be identified as USERS; the teacher partnered with IVC is identified as TEACHER.
In these Terms and conditions of use Italian Video Courses (hereinafter the "General Conditions" also abbreviated with GC) "Italian Video Courses" will be abbreviated with IVC; the registered user who benefits from the free services of the site is identified with the term CLIENT; the user who benefits from the free and the paid services is identified by the term STUDENT; the CLIENT and the STUDENT can also be identified as USERS; the teacher partnered with IVC is identified as TEACHER.
This terms and conditions are applicable to all USERS. At the conclusion of the contract, any divergence or additional provision established will have effect only if it has been clearly written down and there is an agreement between both parties. The GC apply to both free and paid services offered by IVC.
3 Sign up, access to the material and the free informational video chat
3.1 The free material can be consulted by all USERs who access IVC portal, according to the provisions of point 4 present on this GC.
3.2 USERS can register for free on the IVC platform by providing the information required by the registration form in the "Log in/ Sign up".
3.3 The USER is bound to provide complete and truthful information in the registration form's fields. To proceed with the registration, the USER must fill in the fields and accept the GC and the conditions on the processing of personal data (Privacy Policy). Then the USER has to give confirmation by clicking on "Log in/ Sign up".
3.4 To complete the registration, the USER has to set his/her time zone. In this way the USER will be able to see the time availability of TEACHERS and STUDENTS from the “community” according to his/her actual time zone.
3.5 The USER may decide not to communicate his/her time zone , but in doing so, the USER will see all time availability of TEACHERS and other STUDENTS according to the universal time zone (UTC / GMT).
3.6 The USER can change his/her time zone and personal data at any time from the section “Address and timezone" and “ Basic information” respectively. Those sections are accessible on the right side menu in the SA.
3.7 If the USER is interested in purchasing OPLL, he can schedule a free informational video chat (lasting 20 minutes) with one of the TEACHERS. During the video chat the TEACHER will present the educational material and will explain how the platform works. During the video chat the USER has the chance to ask for clarifications, dispel doubts or inform the TEACHER about particular needs. The USER can ask for a video chat by following the instructions that will be presented and by choosing between the available times.
3.8 The request for a video chat will be forwarded to the secretary. The secretary will contact the USER by email to confirm the assignment of a TEACHER and the booking of the chat, based on the time preferences expressed by the USER in the request.
3.9 To participate in the free informational video chat, guaranteeing to possess the minimum technical requirements necessary to perform an HD video calling (point 5 of the GC), the USER is bound to access the SA using the Chrome internet browser, which can be downloaded for free at https://www.google.com/chrome/ (GOOGLE software download page), and then the USER has to click on "ENTER" button on the section “Ongoing class” that will be activated only on the day and hour indicated on the Confirmation letter sent by email from the secretary .
3.10 Both the USER and the TEACHER must connect within 10 minutes from the informational video chat scheduled time. Exceeding this time limit, the aforementioned "ENTER" button will be deactivated preventing the access to the videoconference with the TEACHER.
3.11 If the TEACHER does not connect within the established time, the USER will soon receive an email informing him about the possibility of scheduling a new free informational video chat. In the case that the USER does not connect within the established time, he must get in touch with the secretary to be able to book a new free informational video chat.
3.12 The USER acknowledges and agrees that he can not transfer his/her account and his/her access data to the IVC platform to other persons or entities without explicit IVC written approval.
3.13 The USER acknowledges and agrees not to access nor use other persons account without having the specific written authorization from them and from IVC.
3.14 Children under the age of 14 are prohibited from accessing IVC web portal, except where the parents, guardians or legal representatives have given their consent and assume responsibility for the actions taken by the minor in their custody. If a person under the age of 14 accesses the site, it is presumed that such person is authorized by parents, guardians or legal representatives.
3.15 In order to purchase IVC plans the USER must be at least 18 years old and have reached the majority in his/her Country of residence.
4 The use of free material
4.1 To take advantage of the IVC free material, the USER accepts the GC that regulate its use in the following clauses.
4.2 USERS can share free materials via e-mail and on social networks, but they are prohibited to sell them or use them for commercial purposes. Furthermore, in any way it is allowed to modify or reproduce the material only partially, as described by the license, available on the Creative Commons website at the link http://creativecommons.org/licenses/by-nc-nd/4.0/. Infringers will incur the penalty described in the following clause (4.3).
4.3 IVC will have the right to terminate this contract with immediate and legal effect and to demand payment of a penalty of € 5,000.00, except the greater damage that will consider the potential gains that IVC could have derived from.
4.4 The USER accepts that the comments and/or evaluations he/she made through the specific forms in the final section of the pages of each content, are subject to a mediation by IVC administrators. Comments and/or evaluations will be posted with the username chosen by the registered USER or the name provided by the non-registered CLIENT through a specific field at the time of submitting the comment.
4.5 The USER authorizes to publish comments, evaluations or any content provided through interactive elements of the portal (forms, fields, ...) on IVC and guarantees, confirms and assures under his/her personal responsibility that the aforementioned content he transmitted does not constitute infringement of intellectual property rights of third parties or the moral rights of any person to be depicted, mentioned or referred to in the content. The USER guarantees, confirms and assures under his/her personal responsibility that the aforementioned content is not harmful to young people, is not pornographic, is not racist or abusive or similar nature and that does not offend the common sense of morality.
4.6 The USER authorizes IVC to publish his/her username as well as the profile picture (voluntarily uploaded) in any section of the portal.
4.7 The USER accepts that it is possible to publish content and comments only for personal and non-commercial purposes. Therefore, the USER is not authorized to publish content related to commercial interests, in particular advertising.
4.8 The USER must meet the minimum requirements described in point 5 of the GC, to be able to see and to use correctly the interactive contents of IVC.
4.9 Once registered for free the USER can join the Community by filling the form present on the section “Basic Information” that can be found on the right side menu in the SA.
4.10 the USERs that joined the community can search for new penfriends clicking on “community” on the left side menu in the SA. The members that are shown on this section are able to receive letters.
4.11 The USER authorizes the display of his username, description, age, country of residence, topics of interest and languages spoken in the community profile. Based on this data, users will be able to decide with whom to start a correspondence.
4.12 From the "Exchange letters" item of the right side menu in the SA, the USER can manage the settings relating to his participation in the community.
4.13 To start a new correspondence, the USER will choose one of the members and click on his preview card to see all the profile information and then click on the "write a letter" button.
4.14 All letters composed by the USER are automatically saved as drafts and are available by clicking on the "My letters" section on the SA. The archive of letters shows previously written letters and drafts in chronological order and grouped by pen friends.
4.15 It is possible to attach a chat proposal from the right side menu to the letter.The USER who wants to attach a chat proposal can send 3 timetable proposals for the meeting. The recipient can accept, refuse or propose new times for the meeting.
4.16 The USER can manage his chats from the "Chat management" iten in the SA.
4.17 By entering the SA at the scheduled time for the chat, a "chat in progress" item will be available, from which the chat can be accessed.
4.18 From the SA it is possible to access the chat up to one hour after scheduled start time, but from the chat page it is possible to continue communicating with the other member indefinitely.
4.19 From the chat, it is possible to switch to a video chat by clicking on "go to video chat" from the right side menu.
4.20 Members can take advantage of the material designed to stimulate communication and practice Italian in couples: exercises and games that simulate everyday situations and subject suggestions for chat. This material can be reached by clicking on "Exercises" and then "work -in-pair activities" from the left side menu.

5.1 The USER must possess or must be able to use a broadband Internet connection. IVC does not assume the costs the USER has to access the network.
5.2 The USER and the TEACHER must use an internet connection that registers higher download and upload speeds than 5Mbps.
5.3 The USER must connect to the computer or the device a working webcam and microphone in order to guarantee the communication with the TEACHER.
5.4 To ensure the correct operation of the IVC platform, the USER is bound to access the SA using the Chrome internet browser, which can be downloaded for free at https://www.google.com/chrome/ (GOOGLE software download page). The USER is bound to keep up to date the program by installing any missing extension or plug-in (when browsing the IVC portal, eventually Chrome will inform the USER of the necessity to install or update components) that are essential to guarantee the correct use of all the free and exclusive material's contents and to allow IVC to properly provide the paid services for the benefit of the USER.
6 Further clauses on the use of the exclusive materials and services
6.1 The STUDENT guarantees to meet the minimum technical requirements described in point 5 of these GC.
6.2 The STUDENT undertakes not to share, disclose or broadcast (both privately or publicly) the exclusive materials of IVC for any reason and by any means. The STUDENT, therefore, undertakes to use it only in a personal educational context to learn Italian through the IVC platform.
6.3 All rights on the free and exclusive educational material are private and property of Italian Video Courses of Stefano Manfrin, with the exception of the elements accordingly indicated as property of a third party and used in agreement with their license of use and of the public domain contents. USERS, TEACHERS and third parties can use those contents exclusively in the manner, means and terms allowed by IVC. Infringers will incur the penalty described in the following clause (6.4).
6.4 IVC will have the right to terminate this contract with immediate and legal effect and to demand payment of a penalty of € 5,000.00, except the greater damage that will consider the potential gains that IVC could have derived from.
6.5 The links to external contents accessible from the free and exclusive materials refer to contents already published on the network for free. If they do not fall into the public domain, in accordance with their license of use, the texts (extracts provided for educational purposes as citations), images and other contents are accompanied by a clear description that identifies the author as well as the source of the content. In regards to the content that is being made accessible through external links, not having the possibility to check all the information, IVC assumes that the sources that published them do not violate the rights of third parties and their terms of use and that are in possession of the necessary authorizations in compliance with the law.
6.6 If links to external sources are found to be inactive or not working, please inform the secretary and they will be replaced with working ones.
6.7 The STUDENT allows IVC administrators, as well as all the TEACHERS participating in its educational path, to collect information on his learning progress, in registers where all the achievements, the topics done during the lessons, the homework assigned by the TEACHERS and notes on the personal interests of the STUDENT will be recorded. Exclusively for IVC's administrators, the STUDENT also allows the collection of personal data, addresses, telephone numbers, e-mails or other data that the USER provides of his/her own free will. The STUDENT also authorizes to keep a record of attendances and absences from the lessons as well as the technical difficulties encountered, the lessons paid or not and all the information necessary to ensure an adequate provision of services to the USER.
6.8 The STUDENT allows the exchange of this information between the TEACHERS and the IVC administrators.
6.9 The STUDENT who is member of the community allows IVC administrators to share with the other members of the community the username, city, the knowledge level of Italian, information on the knowledge of other languages, a description and the time availability in order to schedule meetups with the other members. Except for the username, this data can be updated/changed at any time in the "Basic information" section accessible from the SA.
6.10 The STUDENT has the authorization to print the teaching material supporting the OPLL, but is not allowed to record, reproduce, modify, transfer or distribute the content via any mean, technological platform, software, application, technological device or computer network. It is not allowed to share, broadcast or spread (privately or publicly) the educational materials of this website for any reason and by any means. The USER undertakes to access and use the educational material only and strictly for personal purposes concerning his/her educational formation and training. The USER is bound to prevent third subjects from accessing the material of this website. The infringer will be subjected to the penalties described in paragraph 6.5 of these GC.
7 General clauses valid for all IVC products and services
7.1 The prices of the plans are indicated in the section “premium” accessible through the side menu and can change at any moment.
7.2 STUDENTS with active subscriptions will be notified by e-mail of any change in rates in advance, in order to be able to suspend the automatic renewal of the subscription with ease and without any contractual penalty, if they wish to.
7.3 The permit to use different kinds of exclusive educational materials the STUDENTS can access by purchasing different plans is to be considered as temporary for the entire duration of the chosen plan. The use of these materials is regulated more in detail by the clauses of the point 6 of these GC.
7.4 In the Italian version of the site, prices are expressed in Euro (€) and Brazilian Reais (R$, BRL), while in the translated versions the USER can display the corresponding value in other currencies. The exchange rate is provided by BCE (European Central Bank) and are daily updated. For this reason, prices shown in currencies other than Euro (€) may fluctuate according to the performance of the financial markets.
7.5 The USER will purchase in Euro (€), which is why on the order overview page, before completing the payment, the USER will only display the price expressed in Euro.
8 Premium subscriptions
8.1 The USER who gets a Premium subscription has access to all the video lessons of all the levels of knowledge of the Italian language that deal with the theory and give practical examples of all the topics required by the CILS (Official Certifier of Italian as a Foreign Language) in its examination tests.
8.2 In the video lessons pages, together with the interactive exercises, there are writing exercises. The STUDENT can optionally ask for the correction of those exercises to one of the TEACHERS.
8.3 To take advantage of writing exercises’ corrections the STUDENT must activate the option "Writing exercise correction" when subscribing to the "premium" subscription.
8.4 The correction service for writing exercises can also be activated at a later time from the “settings” side menu on the right side of the SA.
8.5 The content of Writing exercises sent by the STUDENT must be relevant to what is requested. The TEACHER can refuse to correct exercises that go beyond what was requested.
8.6 The subscription stipulates recurring monthly (30 days), quarterly (90 days) or semesterly (180 days) payments accordingly to the subscription plan chosen by the STUDENT.
8.7 At the end the subscription is automatically renewed by debiting the stipulated fee on the payment card indicated by the USER as the default payment card.
8.8 The subscription auto-renewal can be easily deactivated at any time by changing the "Activated plans and services" setting directly from the SA. By deactivating the auto-renewal, at the end of the stipulated period (30, 90 or 180 days) the STUDENT will not be charged and therefore he/she will lose the access to the exclusive contents and services.
8.9 The student can reactivate the subscription to the video courses at any time by subscribing to it again.
9 Online private live lessons
9.1 To view the availability of Online private live lessons, it is necessary to be registered in the system (free registration).
9.2 If available, from the ABS the CUSTOMER can consult the times the TEACHERS are available for OPLL.
9.3 The CUSTOMER can select up to 20 lessons for each transaction and obtain progressive discounts based on the quantity of purchased lessons.
9.4 For every 5 purchased lessons the CUSTOMER earns a "lesson recovery" whose operation is explained in clauses 9.20, 9.21 e 9.22.
9.5 The exclusive support material is available throughout the STUDENT's study period: as long as he/she has scheduled lessons or lessons available to schedule.
9.6 The STUDENT will receive the correction of all the writing exercises assigned as homework by the TEACHER.
9.7 The OPLL have a duration of 55 minutes. If the STUDENT wants to take longer lessons he will have to schedule more lessons in succession.
9.8 On the SA it will be available management tools for the purchased lessons.
9.9 To access one lesson, in the SA Click “ENTER” in the section “Ongoing lesson” and follow the instructions.
9.10 If the STUDENT access the lesson but the TEACHER does not activate the lesson within 10 minutes of the scheduled time, the TEACHER will be marked as absent. In this case the STUDENT will be able to reschedule it and will gain an extra “lesson recovery".
9.11 If the TEACHER has already connected but the STUDENT does not enter up to 10 minutes after the schedule time for the lesson, then the STUDENT will be marked as absent.
9.12 If during the lesson there are technical problems that prevent the correct execution of the lesson (the communication between TEACHER and STUDENT is interrupted for more than 10 minutes altogether), the STUDENT have the possibility to suspend the lesson due to technical problems. For that, on the SA, click on “ENTER” in “ongoing lesson” section, then in "Interrupt and run test" button on the just opened window.
9.13 By confirming the action, the lesson will be interrupt, and the USERS must follow the indicated procedures to to perform a speed test on their line and complete the interrupting process.
9.14 The secretary will impartially assign the responsibility to the STUDENT or the TEACHER accordingly to the data obtained.
9.15 If the difficulties depended on the TEACHER line, the STUDENT will be able to reschedule the lesson. On the opposite case the lesson will be archived due to technical problems on the STUDENT line.
9.16 The secretary will consider valid the line speed tests which are executed by the STUDENT and the TEACHER on the time the referred lesson was interrupted.
9.17 To guarantee the impartiality of the analysis, the tests on the lines will be executed by a plug-in external to IVC.
9.18 Both the STUDENT and the TEACHER can cancel booked lessons.
9.19 The STUDENT can book or cancel a lesson from the "Manage lessons" section accessible on “Online lessons” in the SA. If the STUDENT has lessons to schedule, it is possible to do it from ABS on this section.
9.20 The STUDENT can reschedule lessons only with a 72 hours in advance warning and if the STUDENT has “Classes’ make ups” available. if these conditions are not met, the lessons could only be cancelled and are going to be marked as STUDENT’s absence.
9.21 By confirm the reschedule, the first schedule will be cancelled. The “Lesson recovery” available for the STUDENT will decrease by one unit and the lessons available for the STUDENT will increase by one unit.
9.22 If the STUDENT has no more "lesson makeups" at his/her disposal or if he/she cancels a lesson with less than 72 hours notice, the lesson will be marked as STUDENT’s absence. If the STUDENT is aware that he/she is not able to attend a lesson he/she had previously booked due to an unexpected contingency, is invited to notify the TEACHER anyway by clicking on the "Inform absence" button. In any case, even without any STUDENT's intervention, the system will automatically record the STUDENT's absence when he/she doesn’t record his/her presence to the relative lesson.
9.23 If the TEACHER cancels a lesson that was booked by the STUDENT, the STUDENT will always be able to reschedule the lesson.
9.24 The STUDENT can send the writing exercises the TEACHER will assign only if he/she has already booked his/her next lesson.
9.25 The STUDENT will receive a confirmation by e-mail of every action related to the OPLL he/she takes.
9.26 Each lesson will be archived and the register will be accessible for the STUDENT on “Register” item on the right side menu.
9.27 If the STUDENT finds an error regarding the registration of a lesson, he/she is bound to communicate it to the secretary within 3 days from the reception of the lesson's summary. The secretary will verify the case and will update the register according to what really happened. If the STUDENT does not communicate his/her disagreement, the secretary will presume that the STUDENT agrees with what has been reported to him/her and the lesson will be recorded in a non-editable way in the IVC archives.
9.28 Before proceeding with the purchasing of an subscription that includes OPLL, the USER is invited to check the TEACHERS time availability by clicking on the ABS.
9.29 All the TEACHERS time availability are shown according to the time zone set by the STUDENT and can be changed at any time on the "Address and timezone" page accessible from the SA's right side menu.
9.30 To attend the lessons, guaranteeing to possess the minimum technical requirements necessary to perform an HD video calling (point 5 of the GC), the USER is bound to access the SA using the Chrome internet browser, which can be downloaded for free at https://www.google.com/chrome/ (GOOGLE software download page), and, if the use of pop-ups has been blocked, the STUDENT must allow IVC to use them. (IVC is free from intrusive advertising and pop-ups will only be used to offer USERS a better usability of the services).
9.31 The ending time of a booked lesson may be subject to variations and it may be delayed up to a maximum of 10 minutes, in case the TEACHER connects late to the lesson. In this way the 55 minutes of lessons are guaranteed for the STUDENT.
10 Communications between STUDENTS, TEACHERS and secretary
10.1 STUDENTS and TEACHERS are bound to communicate with each other only through the channels provided by the secretary and accessible through the IVC platform.
10.2 IVC does not consider valid any private communication between STUDENTS and TEACHERS.
10.3 If the STUDENT does not agree with the contents of a lesson's summary, he must inform the secretary that will proceed with the case's investigations with the TEACHER. The STUDENT will be contacted shortly by IVC to be updated on the development of the issue.
10.4 The STUDENT and the TEACHER undertake to periodically check the email box provided to IVC.
10.5 IVC will handle disputes between STUDENT and STUDENT or between STUDENT and TEACHER in order to reach a common agreement between the parties. IVC will also take into consideration the STUDENT's and TEACHER's behavioural history to deliberate on the possible responsibilities of the two parties.
11 Conclusion and termination of the contract, conclusion and issuance of the order
11.1 After having read and accepted these GC, and after having read and accepted the Privacy Policy, the USER confirms the order by clicking on "Proceed". The USER will be redirected to the payment gateway of the bank that handles IVC payments to enter the payment card details that he/she wants to use to pay for the order and definitively confirm the payment. The payment will then be processed and if successful, the STUDENT will be redirected back to IVC where he/she will be notified of the success of the transaction.
11.2 The USER can complete the payment by using one of the methods specified at the time of purchasing: for example, by using a credit or debit card.
11.3 The data relating to payment cards that the STUDENT uses to purchase within the platform are not collected by IVC, but are processed by the bank that handles IVC payments. In compliance with the laws in force, the bank will provide IVC with the last four digits of the card used for the payment, its expiration date and an identification number of the contract.
11.4 The STUDENT allows IVC to collect the data mentioned in the previous clause to keep a complete record of the orders made by the STUDENT and to allow the operation of plans that involve recurring payments or to facilitate future purchases within the platform.
11.5 If the USER has already purchased a product or service on IVC, by select an paid product or service it will be offered to proceed with the last payment card used by the USER. By clicking on "Confirm the payment", the USER definitively confirms the order without going through bank's gateway to re-enter the card data.
11.6 The fee for premium subscription will automatically be debited on the payment card indicated as default for payments after the end of the time established on the subscription.
11.7 The USER can change the default payment card at any time clicking on “ payment card” on the right side menu.
11.8 The contract with IVC and the purchase are concluded when the USER is notified of the success of the payment that confirms that the order has been processed: the USER can already use the materials and services included in the purchased plan.
11.9 Subscription plans (to video courses or to the CPI) are considered as fixed-term contracts that are automatically renewed when they expire.
11.10 The STUDENT may decide not to automatically renew the contract when the current subscription plan expires simply by deactivating the "auto-renewal" setting on the section “active subscription” on the SA.
11.11 At the end of a subscription's plan, the STUDENT will receive an email informing him/her that the plan has expired and therefore this e-mail indicates also the termination of the contract.
11.12 In the "Orders" section accessible from the side menu on the SA, the USER can consult a register of all the orders placed on the platform and of all the transactions he/she has completed. In this register are also included transactions that were not successful and therefore were not executed. If the STUDENT requested invoice for any order, the document will be available on this section.
11.13 When the order is processed, the USER will receive a receipt of the payment by email from IVC.
11.14 If the USER wants to receive an invoice for an order, he/she can configure this option by clicking on “address and timezone”, available on the right side menu.
11.15 he USER is bound to provide complete and truthful information.
12 Right to withdraw
12.1 The STUDENT has a period of 14 days to withdraw the contract without giving any reason.
12.2 The term for the exercise of the withdrawal begins on the day in which the contract with IVC is concluded, i.e. from the day on which the STUDENT receives the confirmation via email.
12.3 Before the withdrawal expiration period, the STUDENT may exercise the right of withdrawal from the contract informing IVC of his/her decision by providing any explicit written declaration of his/her decision. For this purpose it is enough to send an e-mail to info@italianvideocourses.com or a letter (using the traditional mail services) to Stefano Manfrin with the following address: Via Correr, 19/6 – 33080 Porcia (PN) – ITALIA.
12.4 To comply with the withdrawal term, it is sufficient that the STUDENT notice concerning the exercise of the right of withdrawal is delivered to the secretary within the aforementioned term (14 days).
12.5 With the receipt of the STUDENT's notice of withdrawal by IVC, the parties contractual obligations are dissolved, except the case in which in the meantime the obligations have been fully or partially executed.
12.6 If during this period the STUDENT takes advantage of OPLL, the reimbursement will be equal to the value of the purchased subscription minus the costs of the lessons he/she has already attended. The cost of the lessons will be charged without taking into account any discount, as the conditions that justify it will become lacking i.e the purchase of a certain amount of lessons.
13 Right to withdraw after 14 days
13.1 The STUDENT may withdraw the contract without any penalty at any time, informing IVC of his/her decision by sending an explicit written declaration to the e-mail address info@italianvideocourses.com or by using the traditional mail services to Stefano Manfrin, Via Correr, 19/6 – 33080 Porcia (PN) – ITALIA.
13.2 If the service has to be interrupted due to reasons of force majeure not dependent on the wishes of the TEACHERS or IVC, STUDENTS who have a valid OPLL plan will be refunded with the value of the OPLL that are included in the plan and that have not been executed, while STUDENTS who have a valid subscription will be refunded with the value of the missing days calculated proportionally over the entire period of the subscription. The contract between the parties will be considered terminated.
14 IVC Promotions
14.1 Other promotions conditions, specifications, prices and regulations will be explained in a dedicated page on a case-by-case basis and change from promotion to promotion. Interested USERS can purchase the promotion by clicking on the specific button. By executing the payment and following the instructions on the dedicated page, the USER accepts the terms and conditions of the promotion.
14.2 If the USER explicitly expresses his/her interest and agreement to receive commercial and promotional information on products and services offered by IVC through one of the interactive sections of the website, the USER authorizes IVC to send him/her such material by email.
15 Contents, materials and accessibility to the IVC portal
15.1 IVC undertakes to ensure the correct functioning of the portal at all times: however, it does not guarantee an uninterrupted access.
15.2 IVC uses the technology currently used in the field to provide its services. In order to be able to make full use of the services offered by IVC, in the same way, the USER must use these technologies and allow them to be used on his/her computer (for example: activate Javascript, authorize cookies and pop-up windows).
15.3 If the USER uses non-current or non-common technologies, he/she may be able to make use of IVC services, content and materials only in a limited way.
15.4 Except in the cases where the content is expressly identified as creative common or it is accompanied by a clear description that identifies the author as well as its source in accordance with its license of use or it fall into the public domain, all texts, images, videos and other contents and works created by IVC and distributed through the IVC web portal are protected by copyright and their use outside the web portal requires the written prior approval of IVC.
15.5 The USER undertakes that he/she will ensure that the data of his registration (username and password) will not be used improperly by third parties. The USER has the obligation to block the access by third parties to the data related to his/her registration. As consequence of his/her personal responsibility, the USER also responds, for example, to the contents published on the IVC website or to communications made with the secretary via his/her profile, purchases, etc...
15.6 IVC does not have the option or the faculty to consult, control or approve all information, content, products or services provided by other websites managed by third parties to which links on the IVC website are referring to.
15.7 IVC refuses all responsibility related to any lawsuit that refers to sites accessible through links in the IVC platform, in particular, and without any limitation, regarding their operation, access, data, information, the files, the quality and reliability of the products, their links and/or their content in general.
15.8 If, in this context, the USER is aware of illegal activities performed by third parties, he/she is bound to immediately inform IVC so that the secretary can cancel the links that allow the access to those sites.
15.9 The access to and the use of the website or the purchasing of IVC plans through the website will never be considered as an act of renunciation, transfer, license or total and/or partial assignment of the IVC aforementioned rights.
15.10 IVC reserves the right to exclude the USER from its offer in case of non-compliance with the terms of this agreement.
15.11 The account of the USER who has been reported from other members for his/her disrespectful behavior, may be blocked in case the report veracity is verified. USERS who have a blocked account will not be able to access the SA to prevent them from getting in touch with other registered members. The USERS will no longer be able to benefit from the purchased products and services; the contract with those USERS will be considered terminated and they will be excluded from the IVC offer.
15.12 The rights the USER granted to IVC and the guarantees as well as the disclaimers and releases mentioned in these GC remain valid even after the termination of the relationship with the USER.
16 Final provisions
16.1 The agreements between IVC and the USER are subject to the Italian Republic's laws. The United Nations Convention on Contracts for the International Sale of Goods is excluded.
16.2 The parties agree to exclude those provisions of Italian international civil law that could cause the exclusive use of any other jurisdiction.
16.3 If a single provision of these GC had to be considered invalid, this would not affect the validity of the remaining provisions, which remain legally binding.
16.4 IVC reserves the right to modify these GC at any time and without indicating the reason for the changes, if these changes are based on changes in the services and paid packages offered by IVC, changes to IVC, or changes of a legal nature or due to technical needs. IVC offer of new services is also included. The modified GC will be sent to the STUDENT in advance by email. If the STUDENT does not raise any objections to the changes made to the GC within a period of six weeks, these changes will automatically be considered accepted. If the STUDENT raises objections, IVC may close the STUDENT account, which will be reimbursed by using the same methodologies described in clause 12.3.
16.5 The USER and IVC acknowledge and agree that these GC, the Privacy Policy and the other legal notices published by IVC constitute the full agreement between the USER and IVC.
16.6 The USER declares that the means by which it is possible to book, cancel, reschedule and in general manage the OPLL are right and fair for himself, the TEACHER and IVC.
16.7 The USER declares that his/her knowledge of at least one of the languages used by IVC to draw these GC up is sufficient to fully understand them.
16.8 The USER declares that he/she has read and accepted the GC and that he/she has understood them and consented to them. The user also declares that he/she had being adequately informed about the characteristics, purposes and methods of use of the materials, products and services offered by IVC.
16.9 All disputes related to this contract will be referred to the exclusive jurisdiction and competence of the forum of Pordenone (Italy).
